PRIVACY NOTICE

As BFTA Mimarlık Müh.İnş. Tur. Tic. Ltd.Şti (the “Company”), we hereby present this Privacy Notice, prepared pursuant to Article 10 of the Personal Data Protection Law No. 6698 (the “Law”), containing information about the Company’s personal data processing activities.

ARTICLE 1: DATA CONTROLLER 

Your personal data may be processed by BFTA Mimarlık Müh.İnş. Tur. Tic. Ltd.Şti, in its capacity as data controller, within the scope explained below. The data controller is the natural or legal person who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system.

ARTICLE 2: PURPOSES OF PROCESSING PERSONAL DATA 

Your personal data is processed by our Company for the following purposes:

  • Conducting human resources processes,
  • Ensuring corporate communication,
  • Ensuring the security of the Company,
  • Carrying out statistical studies,
  • Performing works and transactions arising from the contracts and protocols executed,
  • Fulfilling legal obligations as required or mandated by legal regulations,
  • Establishing contact with natural and legal persons having a business relationship with the Company,
  • Carrying out statutory reporting,
  • Fulfilling the burden of proof as evidence in legal disputes that may arise in the future,
  • Conducting and following up the Company’s legal affairs.


ARTICLE 3: PARTIES TO WHOM PERSONAL DATA MAY BE TRANSFERRED AND PURPOSE OF TRANSFER 

Your personal data may be transferred, limited to the purposes set out below, within the framework of the personal data processing conditions and purposes specified in Articles 8 and 9 of the Law:

  • Planning and carrying out the activities necessary to recommend and promote the products and services offered by the Company, customised according to the preferences, usage habits and needs of the relevant persons,
  • Carrying out the necessary work by business units and conducting the relevant business processes in order to enable the relevant persons to benefit from the products and services offered by the Company,
  • Carrying out the work necessary for the performance of the Company’s commercial activities and conducting the related business processes,
  • Planning and executing the Company’s commercial and/or business strategies,
  • Ensuring the legal, technical and commercial-business security of the Company and of the relevant persons in a business relationship with the Company.

In this context, your personal data may be shared with the Company’s business partners, suppliers, legally authorised public institutions and organisations, and legally authorised private law legal entities.

ARTICLE 4: METHODS OF COLLECTING PERSONAL DATA AND LEGAL GROUNDS 

Your personal data is collected through electronic media such as the website, e-mail, and information and request forms on social media, or in physical environments. The legal grounds for the collection and processing of personal data are as follows:

  • Retention of personal data on the ground that it is directly related to the conclusion and performance of contracts,
  • Retention of personal data for the establishment, exercise or protection of a right,
  • Retention of personal data being necessary for the legitimate interests of the Company, provided that it does not harm the fundamental rights and freedoms of individuals,
  • Retention of personal data for the purpose of the Company fulfilling any legal obligation,
  • Retention of personal data being expressly prescribed by legislation,
  • Existence of the explicit consent of the data subjects in respect of retention activities that require such explicit consent.


ARTICLE 5: RIGHTS OF THE DATA SUBJECT 

Natural persons whose personal data is processed (the “Data Subject”) have the following rights pursuant to Article 11 of the Law by applying to the Company:

  • To learn whether personal data is being processed,
  • To request information if personal data has been processed,
  • To learn the purpose of processing personal data and whether it is used in accordance with its purpose,
  • To know the third parties in the country or abroad to whom personal data is transferred,
  • To request rectification of personal data in the event that it has been processed incompletely or inaccurately,
  • To request the erasure or destruction of personal data,
  • To request that the operations carried out pursuant to the sub-paragraphs above be notified to the third parties to whom personal data has been transferred,
  • To object to a result arising against the person by means of the analysis of the processed data exclusively through automated systems,
  • To claim compensation for damages incurred as a result of the unlawful processing of personal data.


ARTICLE 6: APPLICATION TO THE DATA CONTROLLER 

To exercise the rights listed above, you may submit your requests to our Company in writing with a wet signature, or by using a registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the electronic mail address you have previously notified to our Company and which is registered in our system.

In order for a person other than the personal data subject to make a request, a special power of attorney issued by the personal data subject in the name of the person who will make the application must be presented in respect of the matter. Duly submitted requests will be concluded free of charge within thirty days at the latest, as required by the Law. However, if the response exceeds ten pages, a processing fee may be charged for each page above ten. If the response to the application is provided on a recording medium such as a CD or flash memory, the cost of the recording medium may be charged.

The Company may request additional information in order to determine whether the applicant is the personal data subject and to evaluate the requests, and may address questions to the relevant person in order to clarify the matters stated in the application.
